Family law and Law of inheritance

We provide our Clients legal advice and representation in family and inheritance matters concerning individuals’ property and personal rights.

Family law is a part of Civil law. The main legislation governing this field in Slovenia is the Family Code, which governs marriage, relationships between parents, children and other relatives, adoption, foster care and guardianship.

In the field of family law we provide services:

  • related to divorce and
  • of advice and representation of our Clients in: 
    • divorce proceeding regarding marriage and extramarital unions,
    • proceedings related to matrimonial assets division,
    • proceedings related to the regulation of child support (assessment, payment and non-payment of child support) and the designation of contacts with minors. 

Law of inheritance

Inheritance is characterized by the transfer of assets of the deceased person to another individual or legal entity – the descendant.

According to the Inheritance Act it is possible to inherit objects or rights, which belong to individuals. The act also introduces an obligatory hereditary share for children (natural or adopted) and parents (including adoptive parents).

We provide advice to our Clients and represent them in all matters regarding the succession, such as:

  • succession according to the law
  • succession according to a testament,
  • drafting of inheritance agreements,
  • drafting and revocation of testaments,
  • heritage and inheritance proceedings,
  • contract of care and maintenance and deed of gifts, taking action to claim an obligatory hereditary share,
  • separation and elimination of heritage.
